HC: Shift tasmac outlets near schools, church

MADURAI: The Madurai bench of the Madras high court on Wednesday gave four months time to shift three tasmac liquor shops at Sivakasi in Virudhunagar district.

KKC Balaganesan of Sivakasi had filed the case before the HC bench stating that three liquor shops are functioning near the RC Church and two schools - SHNV Boys Higher Secondary School and SHNV Girls Higher Secondary School in Sivakasi.

The petitioner also said that Rule 8(1) of the Tamil Nadu Liquor Retail Vending (in Shops and Bars) Rules, 2003 is against the Indian Constitution and the Right of Children to Free and Compulsory Education (RTE) Act. Thus, the said rule needed to be declared as ultra vires (beyond the powers) of the Indian Constitution, the petitioner prayed. On that petition, the court ordered for the collector-s inspection to the school sites and adjourned the case to October 5.

When the case came up for hearing on Wednesday, the government side submitted the collector-s report before the court and said the Virudhunagar collector, A Sivagnanam, along with other officials inspected the sites. The team found that the shops are in the commercial area, which is not wrong as per the Tamil Nadu liquor retail vending (in shops and bars) rules. However, the bench was not satisfied with the submission. Following it, the government side expressed its willingness to shift the shops.
